    Votacall Hosted VoIP Warranty Terms & Conditions

    As part of the Managed VoIP Service, Votacall provides a warranty for normal “wear and tear” and malfunctions on standard equipment supplied by Votacall for the managed VoIP service for the initial contract term and does not apply to any renewal period. Please review the complete Warranty terms and conditions. The standard equipment includes Polycom VVX 300,400, 500 and 600 series phones, PoE or Gigabit switches and Managed Routers.  Any wireless phones, video phones or any other equipment not referenced above carries a standard 1 year warranty. Customer shall not modify the Equipment in any way without the express written permission of Votacall. Customer shall not use the Equipment except with the Services provided hereunder. Votacall will attempt to resolve all issues with the Customer by having a Remote Support Engineer contact the Customer to isolate the problem.

    5.1. Warranty – Customer Responsibilities. The Customer will be responsible for equipment damaged due to fire, flood, power surge, inclement weather, onsite disaster, natural disaster or any circumstance where the equipment was moved or resides outside of the originally installed environment by Customer or a non-Votacall authorized Technician. Customer is responsible in its entirety for any loss, theft, damage or malfunction of equipment resulting from exposure to abnormal physical or electrical stress, abnormal environmental conditions, misuse, negligence and abuse. Customer will not sublet or allow the use of the equipment by any third party; or attempt to dispose of the equipment or to grant any interest in the equipment to any third party. If used in violation of these terms, Votacall shall have the right to bill Customer for the full replacement value of damaged equipment.

    5.3. Warranty – Replacement Equipment. Replacement Equipment or parts may be new or reconditioned. Votacall will repair or replace equipment due to normal wear and tear as soon as commercially reasonable after it has confirmed the problem reported by the Customer. Votacall will provide the Customer with the same or similar equipment as soon as commercially reasonable. All products that are replaced will become the property of Votacall. If Votacall finds that equipment reported as faulty is actually in working order, then the Customer will pay the cost of collection and delivery of the replacement VoIP phone and/or equipment. All Equipment shipments are F.O.B. Votacall’s facility. Votacall’s liability for delivery shall cease, and title (if applicable) and all risk of loss or damage shall pass to Customer upon delivery to carrier.
